# Điều 32. Trách nhiệm xác nhận đăng ký kế hoạch bảo vệ môi trường

1. Sở Tài nguyên và Môi trường xác nhận đăng ký kế hoạch bảo vệ môi trường đối với các dự án thuộc đối tượng quy định tại Phụ lục 5.1 Thông tư này.
2. Ủy ban nhân dân cấp huyện xác nhận đăng ký kế hoạch bảo vệ môi trường của dự án, phương án sản xuất, kinh doanh, dịch vụ thuộc đối tượng quy định tại Khoản 1 Điều 18 Nghị định số 18/2015/NĐ-CP, trừ các đối tượng quy định tại Khoản 1 Điều này.
3. Ủy ban nhân dân cấp xã được Ủy ban nhân dân cấp huyện xem xét, ủy quyền xác nhận đăng ký kế hoạch bảo vệ môi trường thuộc thẩm quyền của mình đối với dự án, phương án sản xuất, kinh doanh, dịch vụ quy mô hộ gia đình nằm trên địa bàn một (01) xã. Văn bản ủy quyền cho Ủy ban nhân dân cấp xã xác nhận đăng ký kế hoạch bảo vệ môi trường thực hiện theo mẫu quy định tại Phụ lục 5.2 Thông tư này.
4. Ban quản lý các khu công nghiệp, khu chế xuất, khu kinh tế được cơ quan có thẩm quyền quy định tại Khoản 1 và Khoản 2 Điều này xem xét, ủy quyền xác nhận đăng ký kế hoạch bảo vệ môi trường đối với các dự án đầu tư, phương án sản xuất kinh doanh, dịch vụ trong khu công nghiệp, khu chế xuất, khu kinh tế theo quy định tại điểm d Khoản 1 Điều 19 Nghị định số 18/2015/NĐ-CP. Văn bản ủy quyền cho Ban quản lý các khu công nghiệp, khu chế xuất, khu kinh tế xác nhận đăng ký kế hoạch bảo vệ môi trường thực hiện theo mẫu quy định tại Phụ lục 5.3 Thông tư này.
