# 1. Bổ sung Điều 27a vào sau Điều 27 như sau:

“Điều 27a. Lập báo cáo đánh giá tác động môi trường cho dự án có phân kỳ đầu tư hoặc phân chia thành các dự án thành phần

1\. Trường hợp dự án đầu tư được cơ quan có thẩm quyền cho phép phân chia thành các dự án thành phần thì báo cáo đánh giá tác động môi trường được lập cho từng dự án thành phần có tiêu chí về môi trường thuộc đối tượng phải thực hiện đánh giá tác động môi trường.

2\. Trường hợp dự án đầu tư có tiêu chí về môi trường thuộc đối tượng phải thực hiện đánh giá tác động môi trường và được phân kỳ đầu tư theo quy định của pháp luật, chủ dự án được lựa chọn lập báo cáo đánh giá tác động môi trường cho mỗi giai đoạn thực hiện phân kỳ đầu tư hoặc báo cáo đánh giá tác động môi trường cho dự án tổng thể.

Trường hợp chủ dự án lựa chọn lập báo cáo đánh giá tác động môi trường theo phân kỳ đầu tư thì báo cáo đánh giá tác động môi trường của phân kỳ sau phải kế thừa, cập nhật nội dung đánh giá tác động môi trường đã thực hiện cho các phân kỳ trước đó của dự án. Quyết định phê duyệt kết quả thẩm định báo cáo đánh giá tác động môi trường của phân kỳ sau thay thế Quyết định phê duyệt kết quả thẩm định báo cáo đánh giá tác động môi trường còn hiệu lực của phân kỳ trước đó.

3\. Tiêu chí về môi trường để phân loại dự án đầu tư quy định tại khoản 2 Điều này được xác định theo dự án tổng thể.”.
