Đối với trường hợp không phải đóng cửa mỏ do giấy phép khai thác khoáng sản chấm dứt hiệu lực hoặc tổ chức cá nhân có đề nghị trả lại giấy phép khai thác khoáng sản nhưng chưa tiến hành hoạt động khai thác khoáng sản, trong thời hạn 90 ngày kể từ ngày giấy phép khai thác khoáng sản chấm dứt hiệu lực hoặc có quyết định thu hồi giấy phép khai thác khoáng sản, nơi nhận tiền ký quỹ hoàn trả tiền ký quỹ cho tổ chức, cá nhân.”.
