# Điều 12. Chuyển quyền sở hữu hạn ngạch phát thải khí nhà kính, tín chỉ các-bon

1\. Tổng công ty lưu ký và bù trừ chứng khoán Việt Nam thực hiện chuyển quyền sở hữu và ghi nhận sở hữu hạn ngạch phát thải khí nhà kính, tín chỉ các-bon cho chủ thể tham gia giao dịch ngay sau khi hoàn tất thanh toán giao dịch. Cuối mỗi ngày giao dịch, Tổng công ty lưu ký và bù trừ chứng khoán Việt Nam có trách nhiệm gửi Bộ Nông nghiệp và Môi trường kết quả thanh toán, số dư sở hữu hạn ngạch phát thải khí nhà kính, tín chỉ các-bon cuối ngày trên các tài khoản lưu ký hạn ngạch phát thải khí nhà kính, tín chỉ các-bon để Bộ Nông nghiệp và Môi trường cập nhật vào Hệ thống đăng ký quốc gia.

2\. Bộ Nông nghiệp và Môi trường hướng dẫn và thực hiện chuyển quyền sở hữu hạn ngạch phát thải khí nhà kính, tín chỉ các-bon ngoài hệ thống giao dịch các-bon đối với các trường hợp không quy định tại khoản 1 Điều này. Trường hợp hạn ngạch phát thải khí nhà kính, tín chỉ các-bon đã ký gửi tại Tổng công ty lưu ký và bù trừ chứng khoán Việt Nam, Bộ Nông nghiệp và Môi trường chỉ được chuyển quyền sở hữu ngoài hệ thống giao dịch các-bon sau khi hạn ngạch phát thải khí nhà kính, tín chỉ các-bon đã được rút ký gửi khỏi hệ thống lưu ký và thanh toán giao dịch các-bon.
