# Điều 4. Tổ chức thu phí

1\. Sở Tài nguyên và Môi trường, Phòng Tài nguyên và Môi trường thu phí bảo vệ môi trường đối với khí thải của các cơ sở xả khí thải trên địa bàn quản lý.

2\. Căn cứ tình hình thực tế quản lý, Sở Tài nguyên và Môi trường báo cáo Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương (*sau đây gọi chung là Ủy ban nhân dân cấp tỉnh*) chỉ đạo Sở Tài nguyên và Môi trường, Phòng Tài nguyên và Môi trường tổ chức thực hiện thu phí bảo vệ môi trường đối với khí thải của các cơ sở xả khí thải trên địa bàn quản lý.
