# Điều 30. Xử lý một số vấn đề liên quan đến phân định thẩm quyền

1\. Sự cố môi trường quy định tại khoản 1 Điều 123 Luật Bảo vệ môi trường bao gồm các cấp: sự cố môi trường cấp cơ sở, sự cố môi trường cấp xã, sự cố môi trường cấp tỉnh, sự cố môi trường cấp quốc gia.

2\. Sự cố môi trường cấp xã là sự cố môi trường vượt quá phạm vi sự cố cấp cơ sở và có phạm vi ô nhiễm, suy thoái môi trường trong địa bàn của một đơn vị hành chính cấp xã.

3\. Sự cố chất thải cấp xã là sự cố môi trường do rò rỉ, tràn đổ, phát tán chất thải trong quá trình phát sinh, thu gom, lưu giữ, trung chuyển, vận chuyển, sơ chế, xử lý, đồng xử lý, tái chế, thu hồi năng lượng, tiêu hủy chất thải trong địa bàn của một đơn vị hành chính cấp xã.
