# Điều 104. Xây dựng, thẩm định và công bố tiêu chuẩn môi trường

1\. Thẩm quyền, trình tự, thủ tục xây dựng, thẩm định tiêu chuẩn môi trường thực hiện theo quy định của pháp luật về tiêu chuẩn và quy chuẩn kỹ thuật.

2\. Bộ Tài nguyên và Môi trường tổ chức xây dựng và đề nghị thẩm định tiêu chuẩn quốc gia về môi trường.

3\. Bộ Khoa học và Công nghệ tổ chức thẩm định và công bố tiêu chuẩn quốc gia về môi trường.

4\. Cơ quan, tổ chức xây dựng và công bố tiêu chuẩn cơ sở về môi trường theo quy định của pháp luật về tiêu chuẩn và quy chuẩn kỹ thuật.
