1\. Việc cấp giấy phép môi trường được thực hiện trên cơ sở thẩm định báo cáo đề xuất cấp giấy phép môi trường.

2\. Dự án đầu tư, cơ sở, khu sản xuất, kinh doanh, dịch vụ tập trung, cụm công nghiệp thuộc đối tượng phải có giấy phép môi trường có tiến hành công việc bức xạ thì ngoài việc thực hiện theo quy định của Luật này còn phải thực hiện theo quy định của pháp luật về năng lượng nguyên tử.

3\. Bộ trưởng Bộ Nông nghiệp và Môi trường quy định chi tiết về hồ sơ, thời hạn, nội dung và tổ chức thẩm định cấp giấy phép môi trường.”.
